A SAP evaluation is a mandatory federal requirement for safety-sensitive employees who violate Department of Transportation drug or alcohol testing regulations. It is the first and most critical step in the DOT return-to-duty process, designed to protect public safety while providing a structured path for employees to return to regulated work.

When a driver or other safety-sensitive employee receives a verified positive drug test, an alcohol test above the permitted limit, or commits a refusal to test, DOT rules require immediate removal from safety-sensitive duties. At this point, the employee must be referred to a DOT-qualified Substance Abuse Professional (SAP). Returning to work is not permitted until the entire SAP process is completed.

The SAP evaluation involves a face-to-face or telehealth assessment conducted by a qualified SAP. During this evaluation, the SAP reviews the circumstances of the violation, the employee’s substance use history, and any risk factors that may affect safe job performance. Based on this assessment, the SAP develops a personalized education or treatment plan that the employee must complete exactly as prescribed.

Compliance with the SAP’s recommendations is mandatory. Employees cannot substitute programs, shorten timelines, or skip steps. Failure to follow the plan can delay or restart the return-to-duty process, extending time away from safety-sensitive work.

After completing the required education or treatment, the employee must return to the SAP for a follow-up evaluation. The SAP determines whether the employee has demonstrated successful compliance. Only after receiving written authorization from the SAP can the employee take a DOT return-to-duty drug or alcohol test. A negative test result is required before resuming safety-sensitive duties.

The DOT return-to-duty process does not end with reinstatement. The SAP also establishes a follow-up testing plan that includes unannounced tests over a period that may last up to five years. Employers are legally required to implement this plan in addition to standard random testing programs.
