New Delhi, October 2025:
The Office of Senior Advocate Sidharth Luthra has issued a statement following the recent decision by the Special Judge for SPE & ACB Cases, Vijayawada, which dismissed the bail applications filed by seven accused individuals in Crime No. 21 of 2024, linked to the ongoing probe into alleged irregularities in the Andhra Pradesh liquor procurement process.
The Court’s detailed orders underscore its acceptance of the prosecution’s submissions, presented by Senior Advocate Luthra, and reinforce the legal principles governing economic offences, successive bail petitions, and the continued right of investigation under law.
Judicial Recognition of Economic Offence Gravity
The Vijayawada Court reaffirmed the principle that economic offences — involving public funds and systemic abuse — require a stricter standard when considering bail. Citing Supreme Court precedents, the Court held that such crimes impact public trust and the national economy, demanding judicial restraint in granting bail.
No Material Change in Circumstances
The defence’s argument that the filing of a charge sheet constituted a change in circumstances was rejected. The Court clarified that procedural developments do not automatically justify bail unless supported by new substantive evidence or altered factual positions.
Prosecution’s Right to Continue Investigation
Highlighting the prosecution’s prerogative under Section 173(8) of the CrPC, the Court upheld the right to pursue further investigation, particularly as new financial and digital trails are being uncovered. This includes examination of foreign transactions and the tracing of unaccounted funds related to the alleged conspiracy.
Evidence and Forensic Support
The orders also acknowledged the strong evidentiary foundation placed on record, including forensic reports, digital communication data, and witness statements, forming a prima facie case that justified the continuation of custody.
Medical Bail Pleas Dismissed
The Court noted that none of the applicants demonstrated any medical emergency necessitating release. Adequate medical facilities are being provided within custody, ensuring humane treatment while preserving the integrity of the ongoing investigation.
Commitment to Due Process
The proceedings have been marked by judicial fairness and procedural diligence, with the Court recording appreciation for the prosecution’s methodical approach. The decision reinforces the judiciary’s role in upholding transparency, accountability, and the rule of law in economic offence cases.
