Alvear Homes Releases Free Guide to North Carolina’s New ADU Law for Charlotte-Area Homeowners

Alvear Homes has published a free guide explaining North Carolina’s new ADU law, which requires larger cities to allow backyard homes on single-family lots starting in 2027.

Alvear Homes, a bilingual real estate agency serving the Charlotte metro and Fort Mill, S.C., has released a free guide titled “NC’s New ADU Law: Homeowners in Larger Cities Can Now Add a Backyard Home.”

The guide explains the accessory dwelling unit (ADU) provisions of North Carolina’s Regulatory Reform Act of 2026 (Senate Bill 445), which was signed in August 2026. Under the law, cities with 50,000 or more residents outside the coastal area must allow at least one ADU with single-family homes. The rules apply to permit applications submitted on or after January 15, 2027, and cities must adopt local rules by July 1, 2027.

Covered cities generally cannot:

Require extra parking for an ADU
Charge higher permit fees than for a single-family home
Cap ADUs below 800 square feet
Block long-term rentals of both the main home and the ADU

The guide also explains important exceptions, including historic districts and private HOA covenants. It covers estimated building costs and Charlotte’s Queen City ADU Program, which offers up to $80,000 in forgivable financing. It also explains what the law means for buyers and sellers.

“This law gives many North Carolina homeowners new options for using their property,” said [Jeannie Alvear], co-founder of Alvear Homes. “We want families to understand the rules, check their HOA documents, and plan carefully before they build.”
