Baar (September 23, 2026) – SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 124.26, reporting on New Mexico’s issuance of new guidance on labeling products containing intentionally added per- and polyfluoroalkyl substances (PFAS).
The July 2026 guidance follows a May 2026 final rule implementing the PFAS Protection Act (Chapter 102, 2025 (House Bill 212)). Codified as Title 20, Chapter 13, Part 2 of the New Mexico Administrative Code (20.13.2 NMAC), the rule establishes notification, labeling and sales prohibition requirements for consumer products containing intentionally added PFAS, subject to specified exemptions. Labels must display an Erlenmeyer flask with the word ‘PFAS’ inside the flask.
Stakeholders across the consumer product supply chain, including manufacturers, importers, distributors and retailers operating in New Mexico, are affected by the guidance. Unless a product is exempt, manufacturers must label any consumer product containing intentionally added PFAS by January 1, 2027, and display the label in online and catalog sales materials.
The guidance provides examples and recommended labeling practices for products, packaging and online or catalog sales materials. It also addresses labeling approaches for complex durable goods, the use of PFAS labels or disclaimers from other states and conditions for exemptions and waivers.
SGS experts publish SafeGuardS to keep stakeholders informed about regulatory changes that could impact their business. SafeGuardS 124.26 provides further information on the PFAS labeling guidance.
Stakeholders are encouraged to refer to SafeGuardS 124.26 for more details.
