Starting the SAP Process Before Employer Clearinghouse Registration: What Drivers Need to Know

Drivers can begin parts of the SAP process before their employer registers the violation in the FMCSA Clearinghouse, but some steps—like return-to-duty testing—cannot move forward until the record is officially entered.

 
You can contact a SAP and schedule your clinical evaluation before your employer registers the violation.
The FMCSA does not prevent a driver from meeting with a SAP early, and many providers encourage this to reduce delays.

The SAP’s initial face-to-face (or virtual) assessment can be completed right away.
Most SAPs allow drivers to begin the evaluation process as soon as they are ready, even if the Clearinghouse still shows no violation record.

Education or treatment recommendations can also be started early.
After the first evaluation, the SAP assigns required steps. These can begin immediately, which often shortens the overall timeline.

However, you cannot complete the return-to-duty test until the employer enters the violation into the Clearinghouse.
The system blocks the test from being recorded until the violation appears in your profile.

The “Return-to-Duty (RTD) Status” in the Clearinghouse must be updated by the SAP.
Even if you’ve already completed coursework or treatment, the SAP cannot update your status until the employer submits the violation.
