NASHVILLE, Tenn., September 15, 2026 — Four people were recently reported to have been seriously injured after having the wrong drugs injected into them instead of anesthesia during medical procedures at a prominent hospital in Nashville. The victims reportedly suffered serious reactions as a result, ranging from heart failure to paralysis — types of injuries that are painful, debilitating, and can change a person’s life forever.

Unfortunately for victims of negligence in Tennessee, a court can award no more than $750,000 to compensate victims for the immense harm done to them for things like past and future pain and suffering, past and future loss of enjoyment of life, permanent injury, and/or disfigurement (harms legally referred to as “noneconomic damages”), all thanks to Tennessee state law.

Under current Tennessee law, the recoverable amount of a victim’s total noneconomic damages is artificially limited, or “capped,” in most cases at $750,000, regardless of how severe the harms suffered by the victim actually were — including death. The law, ironically known as the Tennessee Civil Justice Act of 2011, is a “tort reform” law promoted by big businesses and insurance companies that placed hard limits on how much victims in personal injury and wrongful death cases can recover for the noneconomic damages they suffered. As a result, victims of negligence by private individuals, businesses, or other non-governmental institutions typically can only obtain up to $750,000 for the harm done to their lives no matter how severe their noneconomic damages actually are; even worse, recovery from government entities is capped even lower.

“Big businesses claim the caps are needed to discourage frivolous lawsuits, but that is simply not true,” says Keith Williams of the Keith Williams Law Group. “Rules of Court already forbid attorneys from filing frivolous claims in court. And beyond that, ‘frivolous’ cases are not worth anything — only meritorious, serious cases end up getting capped. Plaintiffs’ attorneys would not be able to keep their office lights on if they were filing frivolous cases that end up being thrown out and subjecting them to court sanctions. The ‘tort reform’ law is simply about big business and insurance companies wanting to avoid responsibility when they are negligent and seriously hurt someone as a result.”

Mr. Williams says the cap is not only unnecessary, but it also ends up punishing actual victims who have suffered significant, life-changing pain, suffering, loss of enjoyment of life, permanent injuries, or disfigurement as the result of another’s negligence.
“To some, $750,000 seems like a lot of money, but it really isn’t in the bigger picture,” Mr. Williams says. “I ask people all the time to honestly answer these questions: would you be willing to suffer immense pain or be paralyzed for the rest of your life for $750,000? Would you be OK with one of your children being killed in exchange for $750,000? Is your ability to lead a pain-free life and to continue being able to do all the things that currently make your life enjoyable worth less money than the $1 million work of art a big business bought as an investment and displays at its corporate headquarters? I’ve never had anyone yet respond ‘yes’ to any of those questions. Yet that is exactly what Tennessee’s caps on noneconomic damages forces on the most seriously injured and harmed victims in our state.”
